Disclaimers & Limitation of Liability

This page sets out, in clear legal terms, the extent and limits of GoTradie's role and responsibility. It applies to every visitor, customer, and tradesperson who uses the GoTradie platform (the app and website at gotradie.co.uk). By using the platform, you accept these disclaimers in full.

1. GoTradie is an Introduction Platform, Not a Service Provider

GoTradie operates an online marketplace that introduces customers to independent, self-employed tradespeople and generates business leads for those tradespeople. GoTradie is not a contractor, employer, agent, or partner of any tradesperson on the platform, and does not itself supply, perform, supervise, or manage any building, repair, maintenance, or cleaning work of any kind.

Any contract for the supply of work, labour, or materials is formed solely between the customer and the tradesperson. The tradesperson attends, quotes, prices, performs, and is responsible for the work in their own name and at their own risk. GoTradie's role is limited to advertising, matching, lead generation, messaging, payment facilitation, and (where selected) payment protection services.

For the avoidance of doubt, nothing on the platform creates any employment, agency, apprenticeship, or partnership relationship between GoTradie and any tradesperson, nor between GoTradie and any customer.

2. No Liability for Tradesperson Work or Damage

To the fullest extent permitted by law, GoTradie accepts no responsibility or liability whatsoever for:

  • the standard, quality, completeness, or fitness for purpose of any work performed by a tradesperson;
  • any loss, damage, injury, death, or consequential loss arising from work performed by a tradesperson, however caused, including damage to property, contents, or structure;
  • any statement, representation, promise, or warranty made by a tradesperson to a customer, whether in chat, in person, or in a quotation;
  • delays, non-attendance, abandonment, or failure of a tradesperson to complete agreed work;
  • any breach of statutory rights or building regulations by a tradesperson;
  • the accuracy, validity, or authenticity of any insurance, identification, qualification, or certification document submitted by a tradesperson, beyond the reasonable checks GoTradie performs at registration.

GoTradie performs vetting checks (identity, qualification, and insurance review) at registration and monitors insurance expiry dates. However, vetting is not a guarantee, warranty, or endorsement of a tradesperson's competence, workmanship, or character, and customers remain responsible for satisfying themselves before engaging a tradesperson, including reviewing their profile, ratings, and reviews.

Your primary remedy for faulty or damaging work is against the tradesperson who performed it — directly, and through their public liability insurance. Their insurance details can be requested at any time, and GoTradie will assist in connecting affected parties with the relevant insurer or claims process.

3. Money-Back Guarantee — Nature and Limits

Where a customer chooses to pay through GoTradie, the job is covered by our 3-month Money-Back Guarantee as described in our Payment Policy. The Guarantee is a discretionary consumer-protection service offered by GoTradie — it is not insurance, a surety, or an unconditional promise of a refund in all circumstances.

Customers expressly acknowledge the following limits:

  • Recovery may be partial. There may be circumstances where not all funds can be recovered — whether because only part of the payment qualifies, funds have already been released, or recovery of the full amount is not possible.
  • Open disputes affect refunds. Where a dispute remains open between the tradesperson and the customer, or where liability or fault is contested, GoTradie may withhold, delay, or apportion any refund until the dispute is resolved.
  • Guarantee applies only to app-protected payments. Jobs where the customer pays the tradesperson directly (private payment) are not covered, and no refund can be offered for them.
  • Excluded conduct. The Guarantee does not cover changes to the agreed scope made directly between customer and tradesperson, damage arising after the job is approved, normal wear and tear, or dissatisfaction based on taste or preference rather than defect.

4. Repair Before Refund — Right of Remedy

GoTradie operates a repair-first policy. Where a defect or dispute is raised, GoTradie will, in the first instance, give the tradesperson the benefit of the doubt and require or encourage the tradesperson to return and remedy the defect at no additional cost, before any refund of protected funds is considered.

Important: If a customer refuses to allow the original tradesperson a reasonable opportunity to return and repair the defective work, and the customer has not opened a dispute through the app before paying, there is a real possibility that some or all of the customer's funds cannot be recovered. Refusing a remedy may reduce or extinguish any refund that might otherwise have been available under the Guarantee.

Customers are further advised that opening a dispute before approving payment — rather than after — substantially strengthens their position. Failing to dispute before payment may negatively affect the assessment and outcome of any future dispute case, including the amount recoverable under the Guarantee.

GoTradie's assessment of any dispute, including findings on fault, the reasonableness of a quotation, and the appropriate remedy (repair, partial refund, or full refund), is final and binding on both parties in respect of the Guarantee.

5. Quotations, Pricing, and Payment Handling

All quotations and prices are prepared and provided by the independent tradesperson. GoTradie publishes advertised rates to promote transparency and requires tradespeople to honour them for jobs booked through the platform, but GoTradie does not price, value, or warrant any individual job. Where GoTradie flags a quotation as underpriced or unfair, this is an administrative fairness review only and does not constitute professional valuation, surveying, or cost advice.

Where payment is made through GoTradie, GoTradie acts as a limited payment facilitator. Processing funds on behalf of a tradesperson does not make GoTradie liable for that tradesperson's work, tax obligations, or conduct.

6. Reviews, Ratings, and Third-Party Information

Star ratings and reviews reflect the opinions of the individual customers who submitted them. GoTradie displays reviews in good faith and operates a moderation and dispute process for them, but GoTradie does not warrant the accuracy or completeness of any review and accepts no liability for decisions made in reliance on reviews or ratings. Reviews are not a guarantee of a tradesperson's future performance.

Content on the platform is provided for general information only and does not constitute professional, legal, financial, or building advice. Nothing on the platform should be relied upon as a substitute for an in-person survey, inspection, or professional opinion.

7. Limitation of Liability

To the maximum extent permitted by law:

  • GoTradie shall not be liable for any indirect, special, incidental, or consequential loss, loss of profit, loss of use, or loss of data arising from use of the platform or any job arranged through it;
  • GoTradie’s total aggregate liability arising from or in connection with the platform, any job, or any dispute — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — shall not exceed the total of the application fee (10% of the client payment) retained by GoTradie in respect of the job concerned, or £100, whichever is lower;
  • nothing in these disclaimers excludes or limits GoTradie’s liability for death or personal injury caused by its own negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded.

Nothing in these disclaimers affects the statutory rights of consumers under the Consumer Rights Act 2015 or any other applicable law.

8. Indemnity by Platform Users

Each customer and tradesperson agrees to indemnify and hold GoTradie harmless from and against any claim, demand, action, cost, or expense (including reasonable legal costs) brought against GoTradie by any third party arising from: (a) the performance, quality, or failure of any work performed by the tradesperson; (b) any act, omission, or negligence of a tradesperson or customer; (c) any breach by the user of these disclaimers, the Tradesperson Agreement, or applicable law.

9. Governing Law and Disputes

These disclaimers are governed by the laws of England and Wales. Before commencing legal proceedings, both customers and tradespeople agree to first contact GoTradie at Info@Gotradie.co.uk and allow GoTradie a reasonable opportunity to investigate and assist in resolving the matter, including through GoTradie's in-app dispute resolution process.

The courts of England and Wales shall have exclusive jurisdiction over any dispute arising from these disclaimers or the use of the platform.
